Terms & Conditions

These Terms & Conditions apply to all services provided by Pixie Brand Studio ("I", "me", "my") to you ("the client", "you"). By booking a service, paying a deposit or invoice, or otherwise engaging me, you agree to these terms.

1. About me
​
Pixie Brand Studio is a sole trader business run by Miss Nicola Hayler, based in Horsham, West Sussex. Contact: info@pixiebrandstudio.co.uk.

2. Services
​
I provide brand identity design, website design, and business support services (including virtual assistant support, social media, email marketing, graphic design and website care plans). The specific services, deliverables and price for your project will be confirmed to you in a quote, proposal or package description before we begin.

3. Quotes & bookings
​

Quotes are valid for 30 days unless stated otherwise.

Your booking is confirmed once you've accepted the quote/proposal and paid the required deposit.

Bookings are taken on a first-come basis and your start date is reserved once your deposit is received.

4. Payments & deposits
​

Deposits are required to secure your booking and start date. Deposits are non-refundable, as they reserve studio time I can't offer to someone else (see clause 7 for your statutory rights as a consumer).

Balances are due as set out in your quote - typically before final files are delivered or a site goes live.

Payment plans (e.g. 40% / 30% / 30%) are available on larger website projects by agreement.

Retainers (VA, social media, email management, care plans) are billed monthly in advance.

Payment is made via bank transfer.

I'm not currently VAT registered, so no VAT is added to my prices.

Late payment: if an invoice is overdue, I may pause work until it's settled. Late payments may incur interest at 5% per week from the due date until payment is received, in addition to any statutory interest and recovery costs permitted under the Late Payment of Commercial Debts (Interest) Act 1998. I reserve the right to pause or withhold work and delivery if payment is more than 5 days overdue. Work will resume once all outstanding balances are settled.

5. Your responsibilities

To keep your project on track, you agree to:

provide the content, information, access and materials I need in good time;

give feedback and approvals promptly at each stage;

ensure any content you provide (text, images, logos) is accurate and that you have the right to use it.

Delays in providing these may affect your timeline, and significant delays may require rebooking.
​
6. Revisions & scope
​
Each package includes the number of revision rounds stated in your quote or package. Additional revisions, or work beyond the agreed scope, will be quoted separately and agreed before I carry them out.

7. Cancellations & refunds
​

Deposits are non-refundable once work is booked, as they reserve your slot.

If you're a consumer (booking for purposes outside a business), you have a statutory right to cancel within 14 days of booking under the Consumer Contracts Regulations 2013. If you ask me to begin work within that period and I do, you may be charged for work done up to the point you cancel, and this right ends once the service is fully performed.

Retainers roll monthly and can be paused or cancelled with 30 days' written notice.

Website care plans have a 3-month minimum term, then roll monthly with 30 days' notice.

If I need to cancel a project, I'll refund any payments for work not yet carried out.

8. Timelines
​
I'll give you an estimated timeline for your project. Timelines are estimates and depend on timely feedback, content and payment from you. I'm not liable for delays caused by circumstances outside my reasonable control.

9. Intellectual property
​

Ownership of final design deliverables transfers to you once your project is paid in full.

Until then, all designs and files remain my property.

Fonts, stock imagery and third-party assets are subject to their own licences, which may need to be purchased in your name.

I may showcase completed work in my portfolio and marketing unless we agree otherwise in writing.

You confirm that any materials you supply don't infringe anyone else's rights, and you agree to cover any claims arising from materials you've provided.

10. Third-party platforms
​
I build on and work within third-party platforms (such as Wix, Squarespace, Shopify and email marketing tools). Any subscriptions, plans or fees for these platforms are your own responsibility and cost. I'm not responsible for changes, outages or issues caused by those platforms.

11. Liability
​

I'll carry out my services with reasonable care and skill.

I'm not liable for any loss of profit, business or data, or any indirect or consequential loss.

My total liability for any claim is limited to the total fees you've paid me for the relevant project.

Nothing in these terms limits liability that can't be limited by law.

12. Confidentiality
​
I'll keep your business information confidential and use it only to carry out your project, except where I need to share it with providers to deliver the work, or where required by law.

13. Governing law
​
These terms are governed by the laws of England and Wales, and any disputes will be subject to the courts of England and Wales.

14. Changes to these terms
​
I may update these terms from time to time. The version in place when you book is the one that applies to your project.
